Prosecutors do not object to the request, Green wrote.
Rick Gates pleaded guilty in February 2018 to two charges brought by special counsel Robert Mueller’s office: one count of conspiracy against the U.S. and one count of making false statements in a federal investigation. The former Trump campaign aide cooperated extensively in Mueller’s investigation, including by testifying against Paul Manafort, Gates’ former boss and co-defendant.
The protracted and wide-ranging cooperation led U.S. District Court Judge Amy Berman Jackson to give Gates relatively light punishment on the two felony counts when she sentenced him last December: 45 days of intermittent confinement sometimes called “weekend jail,” and three years of probation. Jackson will decide whether Gates’ request is granted.
It is unclear how much of the jail term Gates, 47, has served or precisely where he is doing so.
At least two other defendants who pleaded guilty in connection with Mueller’s probe are also seeking early release: Manafort and former Trump personal lawyer Michael Cohen.
Manafort, 71, is serving a seven-and-a-half year sentence at a federal prison in Loretto, Pa., on charges including filing false tax returns, failing to report overseas bank accounts, witness tampering and conspiring to act as an unregistered foreign agent in the U.S.He suffers from a series of ailments and has requested early release from prison authorities. However, the Loretto facility has not reported any confirmed Covid-19 cases. Manafort’s lawyer said his client was put into a pre-release quarantine at the prison March 30.
Cohen, 53, is serving a three-year sentence after admitting to various crimes, including facilitating illegal contributions to President Donald Trump’s 2016 campaign as part of an effort to cover-up alleged sexual indiscretions by Trump. Cohen unsuccessfully sought early release from a federal judge and has now been approved for such release by prison authorities, but is undergoing a pre-release quarantine, according to Cohen’s attorney. The prison in Otisville, N.Y., where Cohen is housed has reported 15 coronavirus infections among prisoners and nine among staff.
Absent changes due to the pandemic, Cohen was scheduled for release in November 2021 and Manafort was due out in November 2024.
