A Gudu Upper Area Court, Abuja, on Tuesday admitted a 62-year-old businessman, Kyrian Onu, to bail in the sum of N100, 000 for allegedly raping a 13-year-old girl.
The judge, Alhaji Umar Kagarko, ordered the defendant to produce two sureties in like sum.
Kagarko said the offence was ordinarily not bailable, but the Prosecutor, Malik Taiwo, did not oppose the bail application due to his age and health.
He said one of the sureties must reside within the court’s jurisdiction, and adjourned the case till Sept. 14 for hearing.
The Defence Counsel, Mr Alika Festus, had applied for the bail of his client on health grounds, adding that the defendant had suffered stroke for years.
He added that the defendant’s wife was present in court and the defendant had been in detention for a month now without any medication.
But, Taiwo, who did not oppose the bail, urged the court to impose a condition to ensure his attendance in court if granted bail.
Taiwo had told the court that the matter was reported at the FCT Police Command, Abuja, that the defendant deceived a 13-year-old girl into his bedroom on June 20.
He said the defendant had unlawful carnal knowledge of the girl contrary sections 282 and 283 of the Penal Code.
The defendant of Jikwoyi Phase 2, Abuja, was arraigned on a one-count charge of rape.
The defendant pleaded not guilty when the charge was read to him.
